13 employers found to have violated various labour laws

KUCHING: Thirteen employers were found yesterday to have violated various laws during the on-going Department of Labour Sarawak’s inspection on the compliance of Minimum Wages Order and Labour Ordinance of Sarawak.

A total of 28 workplaces were inspected and 13 employers were found to have violated various provisions under Labour Ordinance of Sarawak,” said the department in a statement.

The offences were – failure of the employers to keep the personal particulars of their employees (9 cases), failure to keep the particulars on the terms and conditions of employment (9), and failure to keep proper labour register on the employees’ wages and allowances (8).

Others were failure of the employers to notify the department on the start of operations of new companies, and the establishments of the like which carry on business as required under Section 60A of the Labour Ordinance (7), employers’ failure to present wage and allowance register to the employees (6), making payment of wages to the employees through bank without written consent from them (2), failure to pay the employees wages for work on public holidays (2), failure to pay for over time work (2), and failure to display notice on rest day (2).

The operation focused on suspected recalcitrant employers, said the statement, which is under the purview of the Ministry of Human Resources.

“Notices of violation have been issued to the employers concerned for them take corrective action, failing which further actions will be taken against them.

“The operation will be carried out until the end of this month to ensure compliance on the minimum wages order and other relevant labour laws to safeguard the rights of the employees as stipulated under the laws,” the statement added.

The operation was conducted in collaboration with Social Security Organisation (Socso), and Employees Provident Fund (EPF). It focused on compliance among the employers to comply with the Minimum Wages Order (Amendment) 2018, and provisions under Labour Ordinance of Sarawak.

The operation was launched in June, and will end this month-end.
