Contractors urged to apply for refunds of tender deposits

MIRI: Miri City Council (MCC) reminds contractors who have submitted tender for projects and services and who have successfully undertaken their projects, to apply for refund of their tender deposit.

According to the council’s press statement received here yesterday, the refund was subject to terms and conditions as stipulated in the ‘Form of Tender and Tender/Contract Documents’.

“Tender deposits unclaimed for long would be sent to Jabatan Akauntan Negara under Akta Wang Tak Dituntut,” said the statement.

There are two conditions for refund of the tender deposit.

A is for unsuccessful tenderer. Tender deposit would be refunded to the tenderer after the acceptance of the tender or after the expiry of the validity period of the tender, whichever is the earlier.

B is for successful tenderer. The deposit would be returned after the contractor has furnished in its place the necessary security deposit or performance bond for the faithful performance of the contract.

There will be no refund for forfeited tender deposit where the tenderer withdraws his tender after the closing date and before a decision has been made, or refuses to sign a contract after his tender has been accepted.

Those who have fulfilled condition A or B could approach the council’s Contract and Procurement Unit in Public Relations Section (Ground floor of Council Main Building at Jalan Raja, Miri ).

They are to bring along information and supporting document such as the original official receipt of tender deposit (refund will be made according to the name on the receipt), copy of bank account statement that indicates account number and bank’s name for refund purpose, email address and handphone number for refund notification or a copy of security deposit receipt or performance bond letter (for successful tenderer as mentioned in Condition B).

The tenderer would receive their refund deposited into their account within 14 days.
